SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS

Panel Bound Comics (hereinafter, “We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and Privacy Policy [Insert URL Link to your Privacy Policy] (the “Agreement”). By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. This Agreement is limited to the Program and is not intended to modify other Terms and Conditions or Privacy Policy that may govern the relationship between you and Us in other contexts.

1. User Opt In

The Program allows Users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online or application-based enrollment forms. Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the Program. By participating, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from Us. Message and data rates may apply. Message frequency varies.

2. User Opt Out

If you do not wish to continue participating in the Program, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Us. You may receive a final confirmation message. Alternate spellings or phrases will not be recognized as valid opt-outs. You agree that Panel Bound Comics and its service providers will not be liable for failing to honor opt-out requests that do not comply with these instructions.

3. Program Description

Users that opt into the Program can expect to receive messages regarding the marketing, promotion, payment, delivery, and sale of collected comic editions, graphic novels, and related merchandise. Messages may include checkout reminders.

4. Cost and Frequency

Message and data rates may apply. Message frequency may vary based on your interactions. The Program involves recurring mobile messages.

5. Support Instructions

For support, text “HELP” to the number you received messages from or email us at customerservice@panelboundcomics.reamaze.com. Opt-outs must follow the procedures in Section 2 and cannot be processed via email.

6. MMS Disclosure

If your device does not support MMS, you will receive SMS messages instead.

7. Disclaimer of Warranty

The Program is provided “as-is” and may not be available in all areas or at all times. We are not liable for any delays or failures in the receipt of mobile messages. Delivery is subject to effective transmission by your wireless service provider and is outside of Our control.

8. Participant Requirements

You must have a wireless device capable of two-way messaging, be using a participating wireless carrier, and be a subscriber to text messaging services. Not all carriers support the necessary service.

9. Age Restriction

You may not use or engage with the Program if you are under thirteen (13) years of age. If you are between thirteen (13) and eighteen (18), you must have your parent’s or guardian’s consent.

10. Prohibited Content

You agree not to send prohibited content including, but not limited to, fraudulent, defamatory, harassing, obscene, unlawful, or prohibited content by applicable law.

11. Dispute Resolution

All disputes, claims, or controversies between you and Panel Bound Comics (or between you and third-party service providers transmitting messages on our behalf) will be resolved by binding arbitration in Grand Prairie, Texas under the Commercial Arbitration Rules of the AAA. The Panel Bound Comics mobile message service (the "Service") is operated by Panel Bound Comics (“Panel Bound Comics”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or its features without notice. Continued use constitutes acceptance of changes.

By consenting to Panel Bound Comics' SMS/text messaging service, you agree to receive recurring messages from and on behalf of Panel Bound Comics to the mobile number you provided, even if it's on a Do Not Call list. Messages may be sent using an autodialer or other technology. Service-related messages include order updates, account alerts, etc. Promotional messages include specials, offers, and cart reminders.

You do not need to sign up for this program to make a purchase. Your consent is not a condition of any purchase.

We do not charge for the Service, but standard message and data rates may apply. Message frequency varies. Check your plan with your wireless provider for charges.

We may change the short code or phone number used for the Service and will notify you accordingly. Messages sent to old numbers may not be received.

Wireless carriers are not liable for delayed or undelivered messages. You agree to provide a valid mobile number and to sign up again if you change numbers.

To the extent permitted by law, we will not be liable for failed, delayed, or misdirected delivery of messages, any errors, or actions taken based on the Service.
